Renewal Timelines

A registered trademark is valid for a period of 10 years from the date of filing. To maintain legal ownership, the renewal application (Form TM-R) must be filed before the expiry date.

Important: You can file the renewal application as early as 6 months before the expiry date to ensure timely processing.

Late Filing Penalty

If the renewal is missed, the Registrar removes the trademark. You have a chance to restore it within 1 year by paying heavy late fees.

Removal
After 1 year of expiry, the mark is permanently removed.
Restoration
Restoration fee (₹9,000 by e-filing) plus the renewal fee, within one year of expiry.

What is the government fee for renewal?

The government fee for filing the renewal application (Form TM-R) is ₹9,000 (E-Filing) per class. Late fees apply after the expiry date.

Can I renew after the expiry date?

Yes. Within six months after expiry you can renew with a surcharge (₹4,500 extra by e-filing). After that the mark is removed, but it can be restored and renewed within one year of expiry. After one year from expiry it can no longer be restored.

Do I need to renew my logo as well?

Yes. If your logo was registered along with your brand name, the renewal applies to both the word mark and the logo (device mark), protecting the composite mark.
